This writ petition is filed challenging Exhibit P3 order directing cancellation of all the promotions made to the post of Section Officer (FC & D), Section Officer (FC & D) Higher Grade and Pool Officer in the Mahatma Gandhi University with effect from 31.1.2011 and seeking a declaration that without an appropriate amendment to the Ordinance, the post of Pool Officer cannot be abolished, or the promotions already made cannot be cancelled. The petitioners were promoted to the posts of Section Officer (Higher Grade) and Office Superintendent pursuant to the promotions granted on 1.10.2007 and 1.11.2008 respectively. By Exhibit P3 decision of the Syndicate, cancellation of promotions was made to the posts of Section Officer (FC & D), Section Officer (FC & D) Higher Grade and Pool Officer with effect from 31.1.2011. It is contended that the University, in the absence of an Independent Ordinance, has adopted the Ordinance of the Kerala University for governing the service conditions of its staff. It is submitted that in the schedule to Exhibit P4 First Ordinance, the posts of Section Officer and Office Superintendent are included as serial Nos.13 and 18. It is also submitted that the post of Pool Officer was inserted in the Kerala University First Ordinances to provide promotion prospects to typists.
