The challenge in the writ petition is against Ext.P3 demand notice, issued by the 1st respondent board, demanding an amount of Rs.5,16,875/- on the petitioner. The facts of the writ petition would indicate that the petitioner was served with Ext.P1 short assessment bill, along with a demand notice on 13.12.2011. On receipt of the said bill, the petitioner approached the Consumer Disputes Redressal Forum, alleging deficiency in service by the respondent board. The Consumer Disputes Redressal Forum by Ext.P2 order, dated 19.08.2014, found that the petitioner was entitled to a compensation for an amount of Rs.25,000/-. The petitioner was also entitled to litigation costs. The prayer of the petitioner for cancellation of Ext.P1 bill was however, disallowed. It would appear that against Ext.P2 order, the respondent board approached the appellate authority, namely The Kerala State Consumer Redressal Commission, through Appeal No.584/2014. The appellate authority, reduced the compensation allowed to the petitioner to Rs.5,000/- and sustained the rest of the findings of the District Forum.
