“4. I am afraid those contentions cannot be appreciated. True, Exhibit P10 judgment is in respect of the Administrative Department, relating to Exhibit P2 executive order. But, the principle is the same as far as the Finance Department governed by Exhibit P3 executive order is concerned. In the Finance Department the cycle is of 17, first fifteen for Assistants, 16th for Typist and 17th for Confidential Assistants. When the 16th turn of a typist or the 17th turn of Confidential Assistant arises, if there is an Assistant with equal or longer service awaiting promotion, the same Typist or Confidential Assistant will have to concede that turn in favour of the Assistant. That does not mean that the turn is lost once for all. That can only be taken as a pass over. Any other interpretation would be patently unreasonable and would work out unjust consequence as far as the Typist or a Confidential Assistant is concerned because once the vacancy is passed over and if it is to be taken as lost, the next chance would arise only after fifteen vacancies being filled up by the Assistants. As observed by this Court in Exhibit P10 judgment, it is not that difficult to create a pass over when the turn for the Typist or Confidential
