Government Order dated 16/1/2010 was also brought on record along with a statement. The proposed amendment of the Special Rules were filed as Annexure R1(a). It is true that at the time when the original petition was decided, the Special Rules were not amended. But the decision of the Government not to fill up the post of Assistant Conservator of Forests by direct recruitment was communicated. Although the Rules which have been placed before us dated 21st October, 2010 do not indicate that the Rules have been given any retrospectivity, but the Rules having been enforced, where the post of Assistant Conservator of Forests is the post to be filled up by promotion, we see no reason to sustain the direction of the learned Single Judge for cancelling all promotions. In fact, in the original petition, there was no prayer for cancelling any promotion nor any of the promoted candidates were impleaded so as to give them opportunity to defend their promotion. In such circumstances, the direction of the learned Single Judge to cancel all promotions was uncalled for.
