This is an appeal filed by the defendants in O.S.123/08 on the file of the Additional Sub Court, Pala, challenging the judgment and decree rendered on 13.1.2010. By order dated 5th January 2016, the appeal was referred for mediation. Accordingly, the parties entered appearance before the Ernakulam Mediation Centre and after mediation, they finally settled their disputes and entered into a memorandum of settlement dated 5th January 2016.
In view of the settlement thus arrived at, this appeal is disposed of directing that the terms of memorandum of agreement will form part of the judgment and decree in this appeal. It is ordered that the attachment ordered in O.S.123/08 by the Sub Court, Pala will stand lifted.
