The petitioner, who is aggrieved by Ext.P1 order of the Debt Recovery Tribunal had approached this Court through the present OP(DRT), aggrieved by the steps taken by the respondent bank pursuant to default committed by the petitioner in adhering to the direction in Ext.P1 order of the DRT. When the matter came up for admission, this Court by an interim order, granted a stay against recovery proceedings on condition that the petitioner paid an amount of Rs.6,00,000/- on or before 11.1.2016. When the matter came up for orders on 11.01.2016, counsel for the petitioner sought for a week's time to effect payment of the amount directed in the interim order dated 16.12.2015. Thereafter, when the matter was taken up for orders today, it is submitted by counsel for the petitioner that the petitioner could not arrange the funds for making the deposit directed in the interim order date 16.12.2016. Taking note of the said submission, I am of the view that the petitioner is not entitled to the discretionary relief from this Court in these proceedings under Article 227 of the Constitution of India. The OP(DRT) therefore fails and is accordingly dismissed.
