It was in such circumstances, the Tribunal in Ext.P3 ordered that, the applicants be promoted on notional basis to Group D posts on the basis of seniority, against available abolished vacancies, which stood automatically revived as affirmed in C.P.(C)No.95/2009. The Tribunal has made it clear that, if the said exercise has already been done, as stated in Ext.P2 reply statement, no further action is merited. The date of regular appointment of the applicants will be the date of availability of vacancies as ordered in O.A.No.649/2011 and that, the promotion will be on notional basis with effect from date of notional promotion as Group D, which will count for consequential benefits including fixation of pay, seniority, pension and pensionary benefits. Such fixation of pay would however be actual, after catering for annual increment as per rules, from the date of notional promotion. The principle of 'no work no pay' would apply as regards nonentitlement of arrears for the period covering notional promotion, i.e., upto the date when applicants actually took charge of the post.
