JUDGMENT

The above petition was filed challenging the order of the Additional District Court, Thiruvananthapuram in I.A.2549/2006 in O.S.1/2003 under Article 227 of the Constitution of India.

¶54

The counsel for the petitioner has filed a withdrawal memo. which reads as follows:

“ Since petitioner is not interested to pursue this original petition, permission may be granted to withdraw the above original petition. Hence this Hon'ble Court may be pleased to permit the petitioner to withdraw the original petition with liberty to approach this Hon'ble Court to file a fresh original petition in respect of the same cause of action, if necessary.”

When it was pointed out that such a prayer should not be granted, the counsel for the petitioner submitted that he may be permitted to withdraw this petition with liberty to raise all the contentions in the suit. The above submission is recorded and the memo is recorded to the extend mentioned above and the petition is dismissed as withdrawn with liberty for the petitioner to raise all the contentions raised by him in this petition in the suit and if such a contention is raised, the court below is directed to consider all the contentions in the suit untramelled by the observations made in the impugned order.
