1.The petitioner was the accused in C.C.No.1823 of 2009

¶32

on the file of the Judicial Magistrate of First Class-I, Aluva. The aforesaid case has been transferred to the Judicial Magistrate of First Class-IX, Ernakulam and the same is now pending as C.C.No.1215 of 2015. He faces prosecution for the offence punishable under Sections 353 and 309 of the IPC.

2.In this petition filed under Section 482 of the Code of Criminal Procedure, the petitioner seeks for a direction to the court below on his application filed for the purpose of obtaining a No Objection Certificate for enabling him to go abroad. The grievance of the petitioner is that the case has not been numbered by the court below. However, the

report of the learned Magistrate placed before this Court by the Registry reveals that the case has been numbered
