submitted that she was aged 18 years on the date of the alleged incident. She also stated that she had been in love with the 1st petitioner herein for about one and a half years, and she continued the relationship with the hope that he would marry her. As regards the 2nd petitioner, she does not have any complaint or allegation. She stated before me that she came to terms quite voluntarily in the interest of her future, and she apprehends that if the prosecution continues, or if she is exposed to a trial process, it will definitely defile her future life and happy matrimony. I find, on interacting with the victim and on a perusal of the materials, that this is not in fact a case of forceful sexual intercourse. There is reason to believe that whatever happened between the victim and the 1st petitioner was consensual, and the girl was aged 18 years on the date of the alleged incident. That she was taken to some other place by the 1st petitioner will not constitute the offence of kidnapping, because she submitted in open court that she went with the 1st petitioner on her own.
