JUDGMENT

On 4.1.2016, the appellant as well as counsel were

absent. In the circumstances, this court issued notice to appellant through Excise Range Inspector, Mavelikkara and directed him to ensure the presence of the appellant. Accordingly, Excise Inspector, Mavelikkara Range identified the house of the appellant and reported that the appellant died on 18.9.2013. He furnished a report and the Death Certificate issued from Bharanikavu Grama Panchayat which is marked as Ext.C1. In the circumstance, this appeal is dismissed as abated.
