It is submitted by the learned senior counsel appearing on behalf of the respondent that the withholding of amounts, due to the petitioner by way of gratuity, was occasioned on account of the fact that the petitioner was retiring on the same date as the date of the interim order, that is impugned in the contempt petition. He submits that, with a view to comply with the spirit of the interim order, the respondents are prepared to pay the amounts withheld from the petitioner for the time being, on condition that the petitioner gives an undertaking before this Court that he will refund the amount forthwith, if the writ petition is decided against him. The learned counsel for the petitioner undertakes on behalf of the petitioner to refund the amounts paid to him by the respondent, pursuant to the submissions of the learned senior counsel for the respondent, in the event of the writ petition being decided against the petitioner.
