The petitioner is the sole accused in Crime No.2544/2015 of Attingal Police Station for offences punishable under Section 302 IPC.

The allegation of the prosecution is that, on 03.12.2015 at about 7.00 p.m., the petitioner herein poured petrol on his stepfather and lighted match stick was thrown at him. He suffered burn injuries and later succumbed to it. The petitioner herein was arrested on 09.12.2015 and is in custody since then. He seeks bail.

No doubt, the allegation against the petitioner is very serious. According to the prosecution, there was an earlier altercation between the father and the son, which later led to this incident. The allegation of the prosecution is that, it was a premeditated calculated attempt to murder the father.

The investigation has substantially progressed. The dying declaration of the father has also been recorded by the concerned Magistrate. The statements of the crucial witnessed have been recorded. Hence without in any manner viewing the

seriousness of the allegation, having considered the progress made in the investigation, I am inclined to grant bail to the petitioner on the following conditions:

(i) The petitioner shall execute a bond for a sum of Rs.60,000/- (Rupees sixty thousand only) with two sureties for the like sum each to the satisfaction of the jurisdictional Court.

(ii) He shall appear before the Investigating Officer on all Mondays and Saturdays between 9.00 am and 10.00 am for a period of three months or till the final report is filed, which ever is earlier.

(iii) Except for the compliance of the above conditions or for appearance in a Court of law, wherein his appearance is essential, he shall not enter the limits of Attingal Police Station for three months.

(iv) He shall not threaten, coerce or intimidate the defacto complainant and the
