The petitioner is the 1^st accused in Crime No.1493/2015 of Gandhinagar Police Station for the offence punishable under Section 143, 147, 148, 308, 324, 506 read with 149 IPC.

The allegation against the petitioner herein is that he attacked the de facto complainant and caused

bodily injuries. He was arrested on 12.12.2015 and is in custody since then.

Heard both sides and examined the records.

¶25

It is seen that the investigation has substantially progressed. The 2^nd accused has already

been granted bail with respect to this case and the incidents that happened as a sequel to it. A counter case

¶27

was registered as crime no. 1494/2015 of the same Police Station. The wound certificate relating to the injury

caused to the 1^st accused is produced as Annexure-A3. The weapon used by the 1^st accused is a soda bottle and that by the 3^rd accused is a knife. However, it appears that correspondingly there is only one injury. Recovery has also been effected.

Having regard to these facts, I am inclined to

grant bail to the petitioner on the following conditions:

(a) The petitioner shall execute a bond for `40,000/- (Rupees forty thousand only) with two solvent sureties for the like sum to the satisfaction of the learned magistrate having jurisdiction.

(b) He shall not get involved in any other identical offence, and the involvement if any, will be a ground for seeking cancellation of bail.

(c) The petitioner shall appear before the Investigating Officer on all Mondays between 10.00 a.m and 11.00 a.m. for a period of two
