The petitioner stands indicted for offences punishable under Section 379 IPC and Sections 20 and 23 of the Kerala Protection of River Banks and Regulation of Removal of Sand Act.

The allegation of the prosecution is that, on 23.06.2015 at 2.00 a.m., the petitioner was found transporting river sand in a vehicle without valid permission and licence. He was attempted to be intercepted, but he escaped. On the basis of the complaint crime was registered. Apprehending arrest, the petitioner seeks pre-arrest bail.

Heard and examined the records.

The learned Public Prosecutor opposed the application.

¶25

However it was submitted that the petitioner herein is not involved in any other case. The substantial part of the investigation is over with the interception of the vehicle and preparation of seizure mahazar.

Having regard to these facts, I am inclined to grant bail to the petitioner on the following conditions:

Investigation Officer within 10 days from today and shall undergo interrogation. Thereafter if he is proposed to be arrested, he shall be released on bail, on he executing a bond for a sum of 45,000/- (Rupees forty five thousand₹ only) with two sureties each for the like sum.

(ii) The petitioner shall not get involved in any other case of identical nature.

¶32

(iii) He shall appear before the Investigation Officer as and when called for, co-operate with the investigation and shall not threaten, coerce or intimidate the complainant.
