The petitioner is the accused no.18 in Crime No.677/2015 of Nattukal Police Station for offences

¶20

punishable under Sections 143, 144, 145, 147, 148, 307, 332, 333, 324, 325, 326 read with Section 149 of IPC and 3(1) of the P.D.P.P Act.

¶21

The allegation of the prosecution is that on 09.11.2015, the police party was attacked by one named person along with about 150 others. Stones were pelted at the police and wooden sticks were allegedly used. The petitioner herein claims that he has not committed any overtact and is sought to be wrongly implicated in the crime. He seeks bail.

Heard and examined the records.

It appears that one Saheeralai alone is

mentioned by name in the FIS. It is true that, about nine police personnel had sustained injury. Since, it appears

that the pelting of stones came from a crowd of about 150 persons and only person has been named in the FIS, the benefit of pre arrest bail can be extended to the petitioner as follows:

(a) Petitioner shall appear before the

Investigating Officer within ten days from today and shall undergo interrogation. Thereafter, if he is proposed to be arrested, he shall be released on bail on executing a bond

for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties for the like sum each.

(b) He shall not threaten, coerce or intimidate the de facto complainant or his witnesses.

¶32

(c ) He shall appear before the Investigation Officer on all Saturdays between 9.00 a.m. and 10.00 a.m. for a period of two months from the date of execution of the bond as above.

(d) He shall deposit a sum of Rs.3,000/-
