The petitioner is the sole accused in Crime No.126/2016

of Malappuram Police Station, registered under Sections 323, 324, 498-A, 406 and 506(i) IPC.

The petitioner has filed this application under Section 438 Cr.P.C.

Heard.

The learned Public Prosecutor has no serious objection

¶26

in allowing this application. The defacto complainant did not sustain any serious injury in the incident. Since the dispute involved in this case is a matrimonial dispute, if the petitioner is sent to jail, the chance for reconciliation will be hampered. Considering the facts and circumstances of the case including the relationship between the parties, I am inclined to allow this application.

In the result, this application stands allowed and the respondents are directed to release the petitioner on bail in the event of his arrest in connection with Crime No.126/2016 of

Malappuram Police Station, on condition of the petitioner executing a bond for Rs.30,000/- (Rupees Thirty Thousand only) with two solvent sureties, each for the like sum to the satisfaction of the 2^nd respondent, before whom the petitioner shall surrender within ten days, if not arrested in the mean time and subject to the following further conditions:-

(1) The petitioner shall report before the investigating

officer on every Sunday between 9 am and 11 am for three months and thereafter, as and when required by the investigating officer for interrogation.

(2) The petitioner shall not intimidate or influence the witnesses or in any way tamper with the investigation.

(3) The petitioner shall not get involved in any offence during the pendency of this case.
