Petitioner herein is the sixth accused in Crime No.1 of 2016 of Pudukkad Police Station for offences punishable under Sections 143, 144 and 149 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation of the prosecution is that on 01.01.2016 at about 12.30a.m., police party got a secret information that some accused have gathered armed with deadly weapons and was creating a tense situation in the locality. They proceeded to the spot and found 7 persons armed with iron pipes and swords. Two persons ran away from the spot and 5 persons were restrained. It was found that the fifth accused was a juvenile and hence, the remaining four persons were arrested. Petitioner apprehends arrest.

The substantial part of the investigation is over. The role played by the petitioner herein appears to be not very serious though, he is stated to be involved in yet another case. Having regard to the entire facts and circumstances of the case, I feel that

this is a fit case in which pre-arrest bail can be granted to the petitioner subject to the following conditions.

(i) Petitioner shall appear before the Investigating Officer within ten days from today and shall undergo interrogation. If he is proposed to be arrested, he shall be released on bail on he executing a bond for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties for the like sum each.

(ii) He shall appear before the Investigating Officer on all Tuesdays between 9 a.m. and 10 a.m. for a period of two months from the date of execution of the bond as above.

(iii) He shall not get involved in any other identical offence and shall not threaten, coerce or intimidate the de facto complainant or his witnesses.

The anticipatory bail application is allowed as above.
