The petitioner is the accused in Crime No. 240 of 2016 of Railway Polioce Station, Shoranur, registered for the offences under Sections 370 and 370(A) of IPC, Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Section 4 of the Protection of Children from Sexual Offences Act, 2012 and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015.

The prosecution allegation is that on 30.6.2016, the petitioner illegally transported six minor girls belonging to Scheduled Caste and Scheduled Tribe community from Oddisha for the purpose of subjecting them for sexual exploitation or child labour. The above said six girls were found to have been subjected to sexual exploitation on medical examination.

The petitioner was arrested on 10.7.2016

and ever since, she has been in custody.

Heard.

The learned Public Prosecutor has opposed

the application. It appears that there are materials prima facie to connect the petitioner with the commission of offence. The offence alleged against the petitioner is very grave and serious in nature affecting the morale of the society. Considering the nature and gravity of the offence alleged against the petitioner, I am not inclined to grant bail to the petitioner at this stage.

In the result, this application stands dismissed.

Needless to say that the dismissal of the above

application will not take away the right, if any, of the petitioner in approaching the court concerned for statutory bail.
