The petitioner herein is the first accused in Crime

¶20

No.1032 of 2015 of the Paravoor Police Station, registered under Sections 419, 420, 468, 471 and 34 of the Indian Penal Code. He seeks regular bail under Section 439 of the Code of Criminal Procedure. The petitioner's application for pre arrest bail was disposed of by this Court on 18.07.2016 with a direction to surrender before the Investigating Officer, and he accordingly surrendered on 25.08.2016. The petitioner has been in judicial custody since the date of surrender.

The prosecution case is that the petitioner herein sold 6.5 cents of property belonging to the defacto complainant, to the second accused by impersonating the defacto complainant, and also by forging some documents including a sale deed, in 2014. The said property was first transferred by the complainant to the first accused, and later it was transferred to the second

accused. It is not exactly known whether the alleged forgery is in respect of the first document or the second document. Anyway, if at all it is as regards the second document, it is pertinent to note that the complainant himself is a witness to the transaction. I find that things are to an extend, suspicious as regards the allegations, in view of the long standing civil disputes and the property disputes between the parties. Anyway, on a perusal of the Case Diary, I find that investigation is practically over.

In the result, this application for bail is allowed. The petitioner will be released on bail on his executing a bond with two solvent sureties for 50,000/-(Rupees Fifty Thousand only)₹ each to the satisfaction of the learned Magistrate having jurisdiction. Bail is granted on condition that;

a. The petitioner shall report before the Investigating Officer between 10.00 a.m. and 11 a.m. on all Saturdays for a period of two months.

b. The petitioner shall not leave the jurisdictional limits of the Paravoor Police Station for two months.

c. The petitioner shall not in any manner influence or intimidate the witnesses and he shall not have any

contact with the material witnesses directly or over telephone or

otherwise.
