The petitioner is the sole accused in Crime

¶32

No.111/2016 of Mala Police Station for the offences punishable under Sections 279, 337, 338 and 308 of the Indian Penal Code.

The allegation of the prosecution is that, on 19.01.2016, the petitioner was driving a vehicle in a rash and negligent manner and hit against three persons successively. It is alleged that he did not stop the vehicle and thereafter left the place. The further allegation of the prosecution is that had not the first informant moved to one side, he would have been killed in the incident. On the basis of the above statement crime has been registered. Petitioner apprehends arrest.

The allegation constituting offence under Section 308 is one to be established from the evidence of the eye witnesses, attending circumstance and to be gathered from the facts. The statement of the crucial witnesses have been recorded and the mahazar also

prepared. Having regard to these facts, I am inclined to grant

bail to the petitioner, subject to the following conditions:-

(a) Petitioner shall appear before the Investigating Officer within ten days from today and shall undergo interrogation. Thereafter, if he is proposed to be arrested, he shall be released on bail on he executing a bond for a sum of Rs.60,000/- (Rupees sixty thousand only) with two sureties for the like sum each.

(b) He shall surrender his license before the investigation officer at the time of execution of the bond as above. Further directions regarding the release of the license can be issued by the learned Magistrate.

(c ) He shall appear before the investigation officer on all Tuesdays between 9 am and 10 am, for a period of one month from the date of execution of the bond.
