Petitioner is the sole accused in Crime No.77 of 2016 of Mala Police Station for offences punishable under Sections 323 and 308 of the Indian Penal Code.

The allegation of the prosecution is that on 02.01.2016 at 9.30p.m. due to previous enmity, he attacked the de facto complainant with a chopper and caused bodily injuries on him. He was arrested on 13.01.2016 and is in custody since then. He seeks bail.

It appears that he is involved in two other cases but they are under the Abkari Act. The recovery has also been effected. Petitioner is aged about 70 years and investigation has substantially progressed. Having regard to these facts, I am inclined to grant bail to the petitioner subject to the following conditions.

(i) Petitioner shall execute a bond for a sum of Rs.40,000/- (Rupees forty thousand only) with two sureties for the like sum each to the satisfaction of the jurisdictional Court.

(ii) He shall appear before the Investigating Officer as and when called for.

(iii) He shall not threaten, coerce or intimidate the de facto complainant and the witnesses nor shall he interfere in the process of investigation.

(iv) He shall not get involved in any other identical offences.

The bail application is allowed as above.
