offence also things are to an extent doubtful. Anyway, in view of the bar under Section 18 of the SC/ST Act the petitioners will have to approach the learned Magistrate having jurisdiction and seek regular bail. This is a case where the complaint is really doubtful. It is well settled that even in cases where the required elements of the offence under the SC/ST Act are there, the accused can be granted regular bail by the learned Magistrate having jurisdiction. Here, in view of the police report, that no material could be collected so far to substantiate the allegation under the SC/ST Act and that the offence alleged under Section 354 IPC is doubtful, the learned Magistrate will have to take appropriate decision, having in mind the possibility of misuse of the provisions of the SC/ST Act. In view of the police report that the complaint itself is doubtful, the accused can be granted bail, if he deserves bail otherwise. Thus, giving liberty to the petitioners to approach the court below for regular bail, this application is disposed of.
