The petitioner is the 1^st accused in Crime No.116/2015 of Konni Excise Range who stands indicted for offence punishable under Section 55 (i) of the Kerala Abkari Act.

The allegation of the prosecution is that, on 22.12.2015 at about 7.30 p.m, the petitioner was found in possession of 1.780 liters of Indian made foreign liquor in 9 bottles. He was arrested at the spot and is in custody since then. He seeks bail.

Heard both sides and examined the records.

The learned Public Prosecutor on instructions

submitted that the petitioner is not involved in any other crime.

Having regard to the entire allegations, I feel

that bail can now be granted to the petitioner subject to the following conditions:

(a) The petitioner shall execute a bond for

`50,000/- (Rupees fifty thousand only) with

two sureties for the like sum to the satisfaction of the learned magistrate having jurisdiction.

(b) The petitioner shall not get involved in any other identical offence, and the involvement if any, will be a ground for seeking cancellation of bail.

interfere with the course of investigation.
