Petitioner herein is the first accused in Crime No.248 of 2016 of Mavelikkara Police Station for offences punishable under Sections 341, 323, 326 and 394 r/w 34 of the Indian Penal Code.

According to the prosecution, due to the previous enmity, accused Nos.2 to 4 under the instigation and abetment of the first accused attacked the de facto complainant and caused bodily injuries using weapons. Robbery of Rs.65,000/- was also allegedly committed. Petitioner herein was arrested on 01.02.2016 and was remanded on 02.02.2016. He is in custody since then.

It appears that there was civil disputes between the petitioner and the de facto complainant. It is stated to be the motive for commission of the above crime. The investigation has progressed since the arrest of the petitioner herein. He does not appear to be involved in any other crime. Having regard to these facts, the further custody of the petitioner herein may not be essential and bail can be granted to him subject to the following

conditions.

(i) Petitioner shall execute a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for the like sum each to the satisfaction of the jurisdictional Court.

(ii) He shall appear before the Investigating Officer on all Fridays between 9 a.m. and 10 a.m. for a period of two months from the date of his release.

(iii) He shall not threaten, coerce or intimidate the de facto complainant and the witnesses nor shall he interfere in the process of investigation.

(iv) He shall not get involved in any other identical offences.

¶30

The bail application is allowed as above.
