JUDGMENT

The petitioners have approached this Court with the

following prayers:

“1. Call for the records leading to Ext.P10 and issue writ in the nature of certiorari to quash the same to the extent it does not exclude properties having an area less than 2 Ha. as per the provisions of Kerala Restriction on Transfer and Restoration of Lands to Schedule Tribe Act 1999.

2. Writ in the nature of mandamus commanding the 3^rd respondent not to insist for any verified certificate or such other permission relying on Ext.P10 for registering properties covered by Ext.P1.

3. Writ in the nature of mandamus commanding the 5^th respondent to issue possession certificate and accept Basic Tax in respect of properties covered by Ext.P1.

4. Declare that the restrictions imposed by the 2^nd respondent as per Ext.P10 do not apply in the case of the properties covered by Ext.P1.

5. Such other reliefs that the Hon'ble Court deem fit and proper in the facts and circumstances of the case.”

Heard the learned counsel for the petitioners as well as

the learned Government Pleader appearing for the respondents

as well.

The learned Government Pleader submits on the basis of

the instructions received from the 2^nd respondent, that the

¶56

petitioners, as per the title deeds, are having only an extent of

¶59

2.07 Acres. It is further submitted that, a fact adjudication is necessary at the hands of the 2^nd respondent so as to settle the grievance once and for all.

In the said circumstances, petitioners are set at liberty to approach the 2^nd respondent by filing necessary proceedings within 'two weeks' from the date of receipt of a copy of this judgment, upon which, the same shall be considered and appropriate orders shall be passed, after conducting detailed enquiry, also with an opportunity of hearing to the petitioners. This shall be done at the earliest, at any rate, within 'two months' thereafter.

Petitioners shall produce a copy of this judgment, along with a copy of the writ petition, before the 2^nd respondent, for further steps.

The writ petition is disposed of.
