J U D G M E N T

The petitioners are the Head Load Workers, who are engaged in head load work under the 1^st respondent Company. The challenge is regarding the employment of the workers who are members of the BPCL Area Loading and Unloading General Workers Congress affiliated to the Indian National Trade Union Congress. The petitioners admit that the dispute is an Industrial Dispute and they have moved the Conciliation Officer. Necessarily if conciliation fails, the matter has to be referred to the appropriate Government who has to decide on the reference. Needless to say that the conciliation officer has to proceed with the conciliation proceedings and on a settlement being arrived at, obviously, that would be

implemented by all parties. However, on failure of conciliation proceedings, report should be filed before the appropriate Government who has to consider referring the same to the appropriate forum. The conciliation Officer shall take expeditious steps to finalise the same. All the parties shall cooperate and at any rate, conciliation shall be concluded, within a period of four weeks from the date of receipt of copy of this judgment.
