The petitioner who is the owner of a parcel of land situate in a Re-Survey No.324/15 of Ankamaly Village, Aluva Taluk, Ernakulam District filed an appeal challenging the fixation of fair value by the Revenue Divisional Officer, Fort Kochi. That appeal was allowed and the fair value was reduced from 14,00,000/- per Are to 7,50,000/per Are. Pursuant thereto, Exhibit P1 notification dated 10.01.2014 was issued by the District Collector Ernakulam, the appellate authority constituted under section 28 (A) of the Kerala Stamp Act, 1959 for publication in the Official Gazette. The grievance voiced in this writ petition is that though pursuant thereto the petitioner took steps to execute a sale deed in respect of his lands, the third respondent Sub Registrar took a stand that unless Exhibit P1 notification is published in the Official Gazette, it cannot be relied on. In this writ petition, the petitioner prays for a writ in the nature of mandamus commanding the third respondent to register the sale deed to be presented by the petitioner accepting the fair value fixed in Exhibit P1 without waiting for its publication in the Official Gazette.
