Petitioner is the accused in C.P.No.63/2012. It seems because the victim girl is aged less than 18 years, the learned Magistrate has taken it as C.P.Case in view of the provisions contained in the Commissions for Protection of Child Rights Act, 2005. It is stated that the crime was registered alleging offences under Secs.448 and 354 of IPC. The incident took place on 28.8.2011. The FIS was given on 21.11.2011. After conducting investigation, the charge sheet was laid.

Learned counsel for the petitioner submits that the petitioner had left for gulf country on 12.10.2011 and he has been there till now. He wants to come to the native place. He could come to know of this case later. In these circumstances, I am inclined to grant anticipatory bail to the petitioner. Hence, the following directions are issued :-

If the petitioner is arrested, the petitioner shall be released on bail on his executing a bond for Rs.20,000/(Rupees Twenty Thousand only) with two solvent sureties each for the like amount to the satisfaction of the learned Magistrate. If he is not arrested, he will surrender before the learned Magistrate within two weeks from today. Considering the factors mentioned above, the learned Magistrate will grant bail to the petitioner on his executing a bond for Rs.20,000/- (Rupees Twenty Thousand only) with two solvent sureties each for the like amount to the satisfaction of the learned Magistrate and on further conditions that the learned Magistrate may deem fit to impose.
