Petitioners are accused Nos. 1 to 3 in Crime No.344 of 2013 of the Kudiyanmala Police Station for the offences punishable under Sections 341, 323, 324, 294(b), 506(ii), 307 and 354 r/w Section 34 of the Indian Penal Code, are in custody on 27-12-2013 and seeks bail.

Learned Public Prosecutor has opposed the application. It is submitted that on 26-12-2013 at about 03.00 p.m while the defacto complainant and her daughter were going in a car, they were attacked and modesty of daughter of the defacto complainant was outraged.

Learned counsel has requested for bail.

Since the petitioners are in custody from 27-12-2013

and their further detention is not required, I am inclined to grant bail but subject to conditions.

Application is allowed as under:

Petitioners are granted bail in Crime No.344 of 2013 of the Kudiyanmala Police Station and shall be released, if not required to be detained otherwise on their executing bond for Rs.25,000/- (Rupees twenty five thousand only) each with two sureties each for the like sum each to the satisfaction of the

jurisdictional magistrate and subject to the following

(a) One of the sureties shall be a close relative of any of the petitioners.

(b) Petitioners shall report to the officer investigating the case on every alternate Saturday between 10.00 a.m and 12.00 p.m until filing of the final report.

(d) Petitioners shall not get involved in any offence during the period of this bail.

(e) Petitioners shall not intimidate or influence the

witnesses.

(f) In case the petitioners violate any of condition Nos. (b) to (e), bail granted hereby is liable to be cancelled for which the investigating officer may move application before the jurisdictional magistrate (until committal of the case if any, and thereafter, before the learned Principal Sessions Judge concerned) as held in P.K.Shaji Vs.
