Petitioner is the 3^rd accused in Crime No.657 of

2014 of the Kothamangalam Police station for the offences punishable under Secs.143, 144, 147, 148, 323, 324, 294(b), 302 and 212 read with Sec.149 of the Indian Penal Code and Sec.27(3) of the Arms Act, is in custody from 18.03.2014 and seeks bail.

Learned Public Prosecutor has opposed the application. It is submitted that on 16.03.2014 at about 3.30 p.m., the petitioner and others came in motor cycles and attacked several persons of whom Binu and Vishnu died. It is submitted that the petitioner is involved in O.R. No.6 of 2009 of the Mekkappara Forest Range Office for offences under the Wild Life Protection Act and Crime Nos.488 of 2009 and 405 of 2012 of the Kuruppampady Police station for offences under the Sand Act and Motor Vehicles Act.

Learned counsel has submitted that the allegations against the petitioner are not true and that at

any rate, the petitioner cannot be held liable for the offences under Secs.324and 302 read with Sec.34 of the Indian Penal Code.

Having regard to the relevant circumstances

¶25

including antecedents of the petitioner, request for bail cannot be allowed at this stage. But I make it clear that it is open to the petitioner to request for bail after the case is committed for trial.

The application is disposed of with the above

direction.
