counter affidavit that Sri. V.V.K. Mohammed who had been given the right to occupy the shop rooms had passed away on 17.11.2005 and that documents were created in his name even after his death by practicing misrepresentation and forgery with the object of continuing in occupation thereof. Consequently, the rooms are being occupied by the miscreants on the basis of the said fraudulent agreement renewed periodically, for the past eight years. It is also stated that as per a notice dated 19.11.2012 issued to M/s Seenath Fabrics and M/s VKS Communications, the occupants have been directed to vacate the shop rooms. Though the notices were received, it is admitted that they have not vacated the shop rooms so far. It is further admitted in the counter affidavit that the Police have registered Crime No.483 of 2012 with respect to the said incident, for offences under Sections 404, 416, 464, 466, 468, 471 and 474 of the Indian Penal Code.
