J U D G M E N T

The petitioner did receive cheque No.794482 dated 22.05.2012 for Rs. 3,29,760/- towards income tax refund for the assessment year 2008-09. But the cheque could not be encashed since a wrong bank account number was quoted in the refund order.

The petitioner asserts that his bank account number and MICR code are 855410100001585 and 680013352 respectively. But it appears that the cheque has been issued to the bank account number 57011430473 wrongly. The petitioner states that the cheque has already been returned and that a fresh cheque with the correct bank account number and MICR Code deserves to be issued.

I permit the petitioner to move the second respondent for this purpose who shall issue the cheque with the correct bank account number and MICR Code. The second respondent shall see to it that the petitioner gets income tax refund of Rs. 3,29,760/- for the year 2008-09 without delay and at any rate within a period of two months.

The writ petition is disposed of.
