The petitioner is presently working as Overseer Grade-III in the Project Division, Nattika under the Kerala Water Authority. He was constrained to file this writ petition in strange circumstances. The petitioner had a grievance that despite 23 years of service in the cadre of Overseer Grade-III and possession of the required qualification therefor he was not considered for promotion as Overseer Grade-II. While so, he came to see Ext.P1 final seniority list of Overseer Grade-II as on 1.1.2012. To his dismay, he found that he stood promoted as Draftsman Grade-II with effect from 19.7.2007. The petitioner as also the office in which he was then attached, were absolutely unaware about such an order of promotion. In other words, despite the order of promotion on account of failure to communicate the same properly the petitioner had to continue in the post of Overseer Grade-III itself despite being promoted as Draftsman Grade-II. Thereafter, the petitioner obtained Ext.P2 order whereby he was actually promoted to Draftsman Grade-II along with certain others. In Ext.P2 his initials were wrongly typed as M.K' instead of K.M'. Feeling aggrieved by the deprivation of the benefits of promotion despite the issuance of Ext.P2
