The petitioner is a Lab Assistant in VPM SNDP Higher Secondary School. He was granted on Leave Without Allowances for 5 years from 30.09.2008 as per Ext.P1 G.O. dated 14.01.2009. He purchased A.M.U.P.School, Koorikuzhi from one Krishnananda Babu and thereafter applied for exemption from Rule 8 Chapter III of the Kerala Education Rules to enable him to function as its Manager. That was granted as per Ext.P2. Subsequently, the petitioner purchased AUP School, Pallikkal in Chavakkad Educational District and then submitted Ext.P7 application seeking relaxation in terms of Rule 8(2) of Chapter III of the Kerala Education Rules to function as a Manager of the said school as well. This writ petition has been filed mainly seeking for a direction to the first respondent to consider and pass appropriate orders on Ext.P7 application.

I have heard the learned counsel appearing for the petitioner and also the learned Government Pleader. Obviously, Ext.P7 is now pending before the Government. In the said circumstances, without making any observation as to the merits of

the contentions, this writ petition is disposed of with a direction to the first respondent to consider Ext.P7 and pass appropriate orders in accordance with law, expeditiously, at any rate within a period of two months from the date of receipt of a copy of this judgment.
