JUDGMENT

The petitioner has approached this Court with the following

prayers:-

“1. Issue a writ of mandamus or any other appropriate writ, order or direction, directing to the 1^st respondent to receive, consider and dispose the application for license submitted by the petitioner.

2. Issue such other writ or orders or directions, which this Honourable Court duly deem fit and proper in the interest of justice and circumstances of the case.”

The respondent Panchayath has filed a Counter Affidavit

stating that no application has ever been preferred by the petitioner as contended by him and that no proof has been produced by the petitioner with regard to the alleged filing of Ext.P1 before the Panchayath.

The learned counsel appearing for the Panchayath submits that, if a proper application is filed by the petitioner, satisfying the relevant requirements, the same will be considered and appropriate orders will be passed, in accordance with law, within the shortest possible time.

In the above circumstances, the petitioner is relegated to file a fresh application before the respondents, upon which, the matter shall be considered and appropriate orders will be passed, in accordance with law, after giving an opportunity of hearing to the petitioner, at the earliest, at any rate, within 'one month'

from the date of filing the application as aforesaid.

The writ petition is disposed of.

The petitioner shall produce a copy of this judgment, along with a copy of this writ petition, before the respondents, for further steps.
