head loss of earnings, but, no amount was awarded. Taking into consideration the fact that he was admitted as an inpatient for three days for treatment, at least one month's salary should have been awarded towards loss of earnings. The petitioner is a peon working in the Centurian Bank, Ernakulam Branch. He had produced Ext.A7 salary certificate certifying that he was drawing Rs.9,436/-. There is no reason to deny the claim under the head loss of earnings. Therefore, an amount of Rs.5,000/- can be awarded towards loss of earnings. Ext.A6 medical bills shows that the petitioner had expended Rs.3,642/-. This was wrongly noticed by the court below as Rs.1,642/-. Therefore, the petitioner is entitled to an additional compensation of Rs.2,000/under this head. For loss of amenities and enjoyment in life and for pain and suffering Rs.4,000/- and Rs.5,000/- respectively were awarded as against the claim of Rs.50,000/-. The amount fixed as compensation under the said two heads is also inadequate. This Court is of the view that a consolidated sum of Rs.5,000/- can be awarded under the said two heads.
