Heard the learned Public Prosecutor and the learned counsel for the petitioner.

The petitioner is the accused in Crime No.28/1997 of Cheruthuruthy Police Station registered under Sections 279, 337 and 304A of IPC, which is now pending as CC No.28/1997 on the file of the Judicial First Class Magistrate, Wadakkancherry. Allegedly, the petitioner was away in Gulf and due to his nonavailability, the case against him was transferred to the list of long pending cases as LP No.32/2006 on the file of the same court. Now, the petitioner is ready to surrender before the court and his prayer is that the lower court be directed to hear and dispose of the bail application on the date of surrender itself.

Hence, in the facts and circumstances of the case,

Crl. M.C. No. 1897 of 2013

the Crl.M.C. is allowed. The petitioner shall surrender before the Judicial First Class Magistrate, Wadakkancherry within one week from today. In the event of his surrender and filing any application seeking bail, the same shall be heard and disposed of on the same day itself favourably.
