executing a mortgage in favour of the bank by depositing title deeds in respect of the immovable property referred in those documents. The petitioners/accused defaulted in making the payment and therefore the bank officials, towards the recovery of the aforesaid loan amount, visited the secured property shown at the time of availing the loan by the petitioners/accused and according to the bank, to an utter surprise of the bank officials, it was found that the property shown was not the one which actually mortgaged as a security for the aforesaid loan to the complainant bank. It is the further case of the prosecution that, on verification from the Village office concerned, where the property is lying, it was found that the property actually mortgaged was situated far away from the property shown and it was having only low value. As per the allegation, the accused by forging and fabricating, has produced the location plan and possession certificate relating to the property.
