Petitioner is the second accused in Crime

¶23

No.182/2009 of Edathua Police Station for having committed the offences punishable under Section 143, 147, 148, 341, 323, 324, 506(2) and 308 r/w Section 149 of IPC. The petitioner would say that he is innocent and has been falsely implicated. He would claim that he has not committed any act to constitute an offence. According to him, due to political vendetta he was arrayed as accused. It is pointed out by the learned counsel for the petitioner that the first accused has been granted anticipatory bail by this Court.

Learned Public Prosecutor pointed out that final report has been filed and the case against the petitioner has been split up. As he was not available for trial, a non bailable warrant was issued and the case is now pending as LP.40/2011 before the Judicial First Class Magistrate's court, Ambalappuzha.

Learned counsel pointed out that the matter has been settled and no more dispute exists between the parties. Learned

counsel further pointed out that there may be direction to the court below to release the petitioner on bail on his surrender before the court.

After having heard the learned counsel for the petitioner and the learned Public Prosecutor and after having perused the records and considering the entire facts of the case, it is felt that the petition can be allowed as follows:

The petitioner is directed to surrender before the court which issued non bailable warrant and on filing an application for bail, he shall be released on bail on his executing a bond for a sum of Rs. 15,000/- (Rupees Fifteen thousand only) with two solvent sureties for the like sum each to the satisfaction of the said court.
