Petitioner is the accused in Crime No.429 of 2013 of Pathanamthitta Police Station registered for offence punishable under Sections 55(I) of the Kerala Abkari Act. She was found in unauthorised possession of four bottles of Indian made foreign liquor, two bottles containing one litre, one bottle of 900ml and another bottle of 400ml. On her arrest and production before the magistrate, she was remanded to judicial custody.

She was arrested on 05.03.2013, and eversince she continues in detention, is canvassed by counsel for her release on bail submitting that she has been falsely implicated in the case.

Having regard to the submissions made and taking note of the facts and circumstances presented, I find, further detention of petitioner is not necessary for completing the investigation.

i. Petitioner is directed to be enlarged on bail by executing a bond for Rs.20,000/- (Rupees Twenty thousand only) with two solvent sureties for the like sum by each of them to the satisfaction of the Judicial First Class Magistrate, Pathanamthitta.

ii. She shall report before the Station House Officer, Pathanamthitta once in a week on every Monday at a time between 10.00. a.m. and 12.00 noon for a period of six weeks or till completion of the investigation of the crime, whichever is earlier.

iii. She shall not get involved in any criminal case while she continues on bail in the present case, and, if she does, it is open to the magistrate to cancel her bail without any further orders from this court, but, in accordance with law.
