Fortunately, this court is relieved of the burden of stating the facts of the case in detail for the simple reason that the said exercise has already been undertaken by this court while considering BA Nos.9314 and 9315/12 filed by the petitioner herein. This court dismissed the said applications by order dated 17.12.2012. The petitioner now points out that she has been in custody from 10.11.2012 onwards and since the investigation is almost complete and her continued custody is unnecessary. She, therefore, prays for bail.

The learned Public Prosecutor very vehemently opposed the application and pointed out that the final report has not been laid so far.

A good part of the investigation seems to have been completed, going by the materials available in the CD. Since no apprehension is expressed by the Investigating Agency that the petitioner is likely to abscond if released on bail, it is felt that the continued custody of the petitioner is

unnecessary. The applications are accordingly allowed and the petitioner shall be released on bail, subject to the following conditions :

The petitioner shall, in each case, execute a bond for Rs.10,000/- (Rupees Ten Thousand only) with two solvent sureties each for the like sum each to the satisfaction of the court concerned.

The court concerned shall ensure the identity of the sureties and the veracity of the tax receipts produced by the sureties, before granting bail to the petitioner.

The petitioner shall report before the Investigating Officer on every Wednesday between 9 am and 10 am, till final report is filed.

The petitioner shall not tamper or attempt to tamper with the evidence and influence or try to influence the witnesses.

¶29

If any of the conditions is violated, the bail granted shall stand cancelled and the court concerned on being satisfied of the said fact, may take such action as available to him in law.
