O R D E R

The petitioner is an accused in Crime No.85/2013 of Binanipuram Police Station, who is alleged to have committed the offences punishable under section 342, 365, 371, 376 read with 34 of IPC and section 14 (c)of Foreigners Act and Section 67(A) of IT Act and section 3, 5(c), 6(a) (b) of Immoral Traffic Prevention Act, 1956.

The allegation against the petitioner is that the accused 1 to 3 had procured a woman, who hails from Bangladesh for the purpose of prostitution. Petitioner would submit that he has not committed any offence and he is innocent. It is also pointed out that he has been in judicial custody from 15.2.2013 onwards and he is continued to be in custody unnecessarily.

Considering the nature of allegations against the petitioner and the role played by him, his custody seems to be unnecessary. Petition is allowed on the following conditions :

Petitioner shall be released on bail on his executing a bond for Rs.25,000/-(Rupees Twenty five thousand) with two solvent sureties for the like sum each to the satisfaction of JFCM-I North

Paravur.

The learned Magistrate shall ensure the identity of the sureties and also the veracity of the tax receipts before granting bail.

Petitioner shall report before the Investigating Officer on every Thursday between 9 am and 11 am until further orders.

Petitioner shall not tamper or attempt to tamper with the evidence or influence or try to influence the witnesses.

If any of the conditions is violated, the bail granted shall stand cancelled and the JFCM concerned, on being satisfied of the said fact, may take such proceedings as are available to

him in law.
