The petitioner is the owner in possession of 5 cents of property situated in Resurvey No. 120/14 of Puthuvyppu Village. The said property is situated on the eastern side of VypeenMunambam Public road. According to the petitioner, there existed a pathway connecting the said property to the Road, having a width of 20 feet, which was used for ingress and egress to the property. It is stated that the petitioner is doing business of vending fish in the said property and medium and heavy vehicles are being taken to the property through the above said pathway. Property wherein the alleged pathway exists belong to the 1st respondent Grama Panchayat. The 1st respondent had taken a decision to hand over the said property to the 2nd respondent, for construction of an overhead water tank. Grievance of the petitioner is that if a water tank is constructed in the said property, the pathway leading to his business place will be obstructed and it will virtually prevent ingress and egress to the property.
