JUDGMENT
Pius C. Kuraikose, J.
It is submitted on behalf of Mr.Tom Jose Padinjarekara that the parties have come to a settlement. Counsel requested that the case be referred to mediation. We are not inclined to refer the case for mediation as we find that the case was once referred for mediation and that the Mediator submitted a failure report. Counsel on behalf of Mr.Tom Jose Padinjarekara requested for an adjournment. We are not inclined to grant adjournment since the appeal is in the disposal list. We close the appeal without examining the merits on the grounds raised. It is open to the appellant to seek reopening of the appeal by filing an interlocutory application.
