Petitioner is the sole accused in C.C No.473 of 2012 of Judicial First Class Magistrate Court, Ponnani. The aforesaid case has arisen from a crime registered on a complaint given by the second respondent, wife of the petitioner, alleging matrimonial cruelty. Report filed, after investigation by the police, indicted the petitioner for the offence under Section 498A of the Indian Penal Code. Taking cognizance thereof the case was numbered as above, and it awaits trial. Spouses have resolved the matrimonial disputes and they are now living together, is the case of the petitioner for quashing the criminal proceedings against him invoking the inherent jurisdiction of this court under Section 482 of the Code of Criminal Procedure, for short, 'the Code'. An affidavit has been sworn to by the second respondent supporting the case stated as above, submitting further that she has no grievance against the petitioner, her husband.
