This appeal is filed by the State challenging the verdict of acquittal in a case charged against the respondent alleging offences under Secs.457 and 379 of IPC.

It was stated to have been tested by a gold smith, PW3. The accused was stated to have been shown to PW1. She identified him as the accused who committed theft of the gold chain. She also identified MO.1 chain which was worn by her and which was snatched away by the thief.

was alleged to have trespassed into the house of PW1 on the relevant day. The fact that no complaint was given either by herself or by her husband also is a strong indication to hold that the case stated by PW1 is untrue. It is also argued that it was not at all possible for PW1 to identify the culprit since by the time PW1 switched on the light, the accused was seen leaving and so, at the best PW1 could have seen only the back of the culprit and so it was not at all possible to identify the culprit.

ordered the gold ornament to be released to PW2 without conducting any enquiry as required under Sec.452 of Cr.P.C and without even giving notice to PW1. However, since in this case, nobody has come forward claiming release of MO.1, I am not inclined to make any observation regarding the same. But if the complainant woman comes forward with a claim for MO.1 chain it may have to be considered.
In the light of the finding entered earlier, the verdict of acquittal is confirmed and this appeal is dismissed.
