Petitioner in these cases is the fourth accused in

Crime Nos.1088 of 2012, 48 of 2012, 47 of 2012 and 49 of 2012 of Kasaragod Police Station, wherein the allegations are almost the same as against the petitioner. The petitioner would point out that the only allegation against her is that she was present at the time when the defacto complainant handed over money to the person who was actually running the business.

After having heard learned counsel for the petitioner and the learned Public Prosecutor and after perusing the records, it is felt that this is a fit case where the extraordinary jurisdiction needs to be exercised in favour of the petitioner.

Therefore, these applications are allowed on the following conditions:

i) Petitioner shall surrender before the Investigating Officer in each of these cases on or before 13.12.2012, who after interrogation shall produce her before the JFCM court concerned, which court, on application for bail being moved by the petitioner in each of the cases, shall release her on bail on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two solvent sureties each for the like sum each in each of the cases to the satisfaction of the said court.

ii) The learned Magistrate may ensure the identity of the sureties and the veracity of the tax receipts produced by the sureties for the purpose of executing the bond.

iii) Petitioner shall report before the Investigating Officer as and when required by him.

iv) Petitioner shall not tamper or attempt to tamper with the evidence or influence or try to influence the witnesses.

v) If any condition is violated, bail granted to the petitioner shall stand cancelled, and the JFCM concerned may take such steps as are available to him in law.
