Petitioners are accused Nos. 1, 3 and 2 in Crime No.663/2012 of Peermade Police Station, Idukki. The offence alleged against them is under section 498A r/w 34 of IPC. Apprehending arrest, this petition is filed for anticipatory bail.

The first petitioner is the husband of the complainant. Petitioners 2 and 3 are the mother and brother of the first accused. The complainant alleges that the petitioners subjected the complainant to physical and mental cruelty. It was also alleged that her pregnancy was aborted. But the learned counsel for the petitioners submits that it happened to be aborted as she did not take rest as directed by the Doctor, but she went for pilgrimage (Kurisumala).

Considering all the circumstances, the following directions are issued :-

In the event of arrest, the petitioners shall be released on bail on their executing a bond for Rs.20,000/- (Rupees Twenty Thousand only) each with two solvent sureties each for the like amount to the satisfaction of the officer obtaining the bond as above. If not arrested, the petitioners will surrender before the learned Magistrate having jurisdiction within 10 days from this date and will seek regular bail. The learned Magistrate will grant bail to the accused on their executing a bond for Rs.20,000/- and on such other conditions the learned Magistrate may deem fit to impose, if necessary.
