Petitioners are accused Nos. 1 to 6 and 10 in Crime No.216/2011 of Badagara Police Station, Kozhikode. The offences alleged against them are under sections 143, 147, 148, 294(b), 323, 324 and 308 r/w 149 of IPC. Apprehending arrest, this petition is filed for anticipatory bail.

It is submitted by the learned counsel for the petitioners that the aforesaid petitioners were granted bail during the crime stage. The final report was subsequently filed. The case was committed to the court of Sessions and it is now pending before the Additional Sessions Judge, Badakara as S.C.No.546/2011. The learned counsel for the petitioners submits that they have not received summons. Now, non bailable warrants are pending against the petitioners. Hence the following directions are issued:

Petitioners will surrender before the Additional Sessions Judge, Badakara and will apprise the reasons if any for their non appearance on the dates posted for their appearance. The learned Sessions Judge will go through the records as to the correctness of the statement regarding non receipt of summons etc and dispose of the bail application in accordance with law.
